The US e-commerce conglomerate Amazon had its appeal against the anti-trust suspension of its investment arrangement with Future Group denied by the NCLAT in June 2022. However, on 27 May, the Supreme Court overturned this decision.

The order of the Competition Commission of India (CCI) from December 17, 2021, which had fined Amazon INR 202 crore and halted its agreement with Future, was also overturned by a bench of Justices Vikram Nath and Sandeep Mehta. The appeal is granted, Justice Nath remarked in his ruling, because of the reasons mentioned above. The NCLAT's decision of June 13, 2022, and the CCI's ruling of December 17, 2021, are both overturned Justice Nath added.

In a plea opposing the June 2022 judgement of the National Company Law Appellate Tribunal (NCLAT), Amazon petitioned the supreme court, which then issued the order.

Supreme Court Orders Refund to Amazon

Any funds deposited or collected from Amazon as a result of these orders must be reimbursed within eight weeks, as stated by the bench. The Supreme Court further stated that failure to make the return within the allotted eight weeks will result in the outstanding balance being subject to simple interest at a rate of 9% per annum. The interest will be charged right from the beginning on the day the eight weeks have passed until the date of payment.

 In 2019, Amazon.com NV Investment Holdings LLC invested in Future Coupons Pvt Ltd (FCPL), a promoter business of Future Retail Limited, and the CCI began proceedings against them over this investment. This transaction sparked the controversy. The CCI gave Amazon the green light to buy 49% of FCPL in November 2019.
