Delhi High Court Bars Startup Beco From Advertising Against HUL Products

The Delhi High Court has blocked home-care company Beco from launching an advertising campaign against Hindustan Unilever's Vim and Surf Excel products. HUL took on Beco’s #WarOnWhatsHidden campaign, arguing that it was portraying its products as a physical hazard.

The Delhi High Court's one-judge bench has blocked home-care startup BECO's advertising campaign that purportedly associated Vim and Surf Excel products of Hindustan Unilever Ltd. (HUL) with allergic reactions and skin irritations. J

ustice Anup Jairam Bhambhami issued an oral injunction against the advertising campaign on September 10th. Disputed is Beco's '#WarOnWhatsHidden' advertising campaign, which targets HUL's goods. The campaign goes on to say that its products are free of synthetic chemicals like benzisothiazolinone (BIT) and linear alkylbenzene sulfonate (LAS), among others.

Beco’s Response to the Delhi HC Order

HUL informed the court that although businesses have the right to promote their own products, it is defamatory to suggest that a competitor's goods are physically hazardous. Responding to a media query, Beco co-founder Aditya Ruia stated that Beco will completely comply with the provisions of the decision. He said the company stands with the court's decision. Additionally, Beco is speaking with its attorneys about what to do next. He went on to say that the business will never waver from its commitment to doing what it thinks is best for its customers.

He extended his gratitude to everyone who has supported Beco, including customers, partners, vendors, teams, and the entire firm. According to Ruja, Beco's products have maintained their integrity, honesty, and transparency. A division bench of the high court issued an order on 2 September that rejected Mumbai-based Beco's objection to the case being heard in Delhi. The startup claimed that the hoarding was established in Mumbai because that is where both HUL's and Beco's registered headquarters were. Nevertheless, the bench took note of the fact that Beco had also established hoardings in Delhi and that the national capital was also the location of its Goods and Services Tax (GST) headquarters.

Delhi HC’s Ruling Against Beco

For HUL, senior attorney Amit Sibal contended before the sole judge on September 7 that Beco had gone too far with its comparative advertising. According to Sibal, Beco has been trying to get people to switch to its products by making HUL's products look bad. The matter was sent to the single-judge bench to be heard on merit after the division bench declared its jurisdiction ruling definitive. The court made it clear that it did not want Beco to bring up the jurisdiction issue again.

Beco, established in 2019 by Aditya Ruia, Akshay Varma, and Anuj Ruia, produces environmentally friendly consumer goods for the washing machine and the toilet. Some examples of these items are bamboo toothbrushes, facial tissues, floor cleaner, laundry detergent, and dishwashing liquid. Some of its investors include Synergy Capital, Rukam Capital, Asian Paints promoter Manish Choksi, Titan Capital Winners Fund, and others.
