FSSAI Serves Notices to Lotte India, Kubera Foods and FNP Over Product Claims
FSSAI has issued notices to Lotte India, Kubera Foods and FNP for allegedly making deceptive product claims and violating labelling norms. The companies have been given seven days to reply or risk prosecution under the Food Safety and Standards Act, 2006.
In a recent notification, the Food Safety and Standards Authority of India (FSSAI) informed Ferns N Petals (FNP), Kubera Foods, and Lotte India Corporation Private Limited. These businesses were hit with accusations from FSSAI for various food items' false claims and labelling violations.
Companies were further instructed by the food regulator to provide reasons why they should not be subject to action. Three businesses have been given a week to reply, according to a statement published on 8 June by the food authority on X. Additionally, it cautioned that legal action may be taken in accordance with the Food Safety and Standards Act, 2006, in the event that adequate explanations are not provided.

FSSAI Putting Strict Scanner on these firms
FSSAI said Lotte India Corporation was detected utilising non-compliant pre-printed labels carrying its old corporate name without seeking prior approval from the authority. The company's claim that some Choco Pie varieties are 100% vegetarian was also flagged by the authority as possibly misleading. Upon closer examination, it became apparent that the nutritional information on the PEPERO Original Biscuit Sticks and PEPERO Crunchy Biscuit Sticks Carton from Lotte was not presented in the manner mandated by food safety rules.
Furthermore, the authority determined that the vitamin levels of Lolly Bliss lollipops did not meet the requirements set out in the Food Safety and Standards (Advertising and Claims) Regulations. Kubera Foods was handed a notice over their Soft and Fresh Cream Bun Pineapple, with the FSSAI charging that various advertising statements on the package contradicted the product's ingredient list. Claims like "100% Natural" and "No Preservatives, Colours & Flavours" were highlighted prominently, according to the regulating body.
The label does, however, reveal the addition of flavouring chemicals and the usage of synthetic food colourant INS 110 and preservative INS 282. Also served with a notice was Ferns N Petals Private Limited, in relation to its Roasted Almond Chocolate, for allegedly deceptive advertising and inadequate labelling. It was advertised as "Premium Chocolate" even though it included hydrogenated vegetable fat, according to FSSAI. Further, it lacked the obligatory declaration required for chocolates containing vegetable fat in addition to cocoa butter.
FSSAI Backing Customers Over Businesses
Consumers have the right to accurate and transparent product information, according to FSSAI. Customers could be misled and lose faith in food brands if there was a discrepancy between what was advertised and what was actually in the products.
The agency has stated that this latest move is in line with its continuing efforts to combat deceptive statements on food labels and promote honest product information. Heritage Foods was also served with a comparable notice by FSSAI for the "fresh paneer" assertion. The regulator has been using social media more and more to announce enforcement actions against operators of food businesses, whether these actions are the result of consumer complaints or the agency's own sudden realisation.
